In 2021, the Virginia General Assembly passed a law banning expanded polystyrene (EPS) food containers. These single-use foam containers are being phased out because they are harmful to our health, our communities and our environment.

Key Milestones in the Foam Ban
2025, July 1st
Phase One Compliance
Food vendors with 20 or more establishments must adhere to the new regulations.
2026, July 1st
Full Compliance Required
All food vendors are required to eliminate EPS foam containers, marking a significant step towards sustainability.
- EPS foam is not biodegradable so it doesn’t break down naturally; it simply breaks apart into smaller pieces.
- EPS foam is challenging to clean up when littered and is harmful to wildlife
- There are many better options on the market including paper, plant, starch-based, foil & metal products.
Not in food service? You’re still encouraged to make the switch! Any business currently using EPS should explore better packaging solutions.
